Independence in Immigration Courts

Last week, the Immigration Judges joined AILA in asking that Immigration Courts get taken out of the Department of Justice and turned into independent Article I courts. The Senate Bill S.744 as passed adds more much-needed resources to Immigration courts, but does not make them Article 1 courts.

An independent Immigration Court would allow for more transparency, as right now all decisions are strictly not public record. It would also help to develop immigration law more consistently. What qualifies for asylum here in Dallas should not be different than it is elsewhere. We at HRI join the Immigration Judges in asking Congress to give Immigration Courts Article I status!
